These Terms of Use ("Terms") govern your use of Tattoo AI • Design Generator (the "App"). By downloading or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App. The App is provided by Mert Cagan Yerlikaya ("we", "us", "our"), based in Italy. You can contact us at asktattooai@gmail.com.
By using the App, you represent that: • You are legally permitted to use the App in your jurisdiction • If you are a minor, you use the App only with the consent and supervision of a parent or legal guardian Parents and Guardians: • If your child is using the App, you are responsible for supervising their use • You should review these Terms and our Privacy Policy • The App contains tattoo designs that may not be appropriate for all ages These Terms form a binding agreement between you (or your parent/guardian if you are a minor) and Mert Cagan Yerlikaya.
We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on a device that you own or control for personal, non-commercial use, subject to these Terms and applicable law. You may not: • Copy, modify, translate, or create derivative works of the App • Attempt to extract, reverse engineer, decompile, or access the App's source code (except where allowed by law) • Rent, lease, sell, distribute, or sublicense the App • Use the App to harm, overload, or disrupt our services or systems • Use the App in a way that violates any law, regulation, or third-party rights
The App may offer auto-renewable subscriptions (such as weekly or yearly plans) that unlock premium features. • Some subscriptions may include a free trial period (such as 3 days). You will be charged when the trial ends unless you cancel before then • All payments and billing are handled by Apple through your App Store account • Subscription prices and details are displayed in the App Store listing and may change over time • Subscriptions renew automatically unless you cancel at least 24 hours before the current period ends • You can manage or cancel your subscription in iOS Settings > Apple ID > Subscriptions • When you cancel, you retain access to premium features until the end of the current billing period • Refunds, if any, are governed by Apple's refund policies and applicable local law We do not collect or store your full payment card information; this is handled by Apple.
The App uses third-party services, including but not limited to: • Firebase (backend infrastructure) • AI image generation providers (to process your prompts and images) • Apple App Store and related frameworks (for billing and subscription management) These third-party services are governed by their own terms and privacy policies. Your use of such services is subject to those terms. We do not control and are not responsible for their independent actions or policies.
"User Content" means designs, images, prompts, or other material you create or upload using the App. • You retain ownership of your User Content • By using the App, you grant us a limited license to process, store, and display your User Content as necessary to operate the App and provide features • You represent that you have all necessary rights to the content you upload or create • You represent that your content does not violate any rights of others You agree not to use the App to upload or create content that is: • Illegal, infringing, or violating the rights of others • Defamatory, hateful, harassing, or threatening • Pornographic, abusive, or otherwise harmful under applicable law • Inappropriate for the age of the user We may, at our discretion, remove or restrict access to User Content that we reasonably believe violates these Terms or applicable law.
At this time, the App uses anonymous identifiers and does not require a traditional account with email and password. If we introduce account-based features in the future: • You (or your parent/guardian if you are a minor) will be responsible for maintaining the confidentiality of login credentials • You will be responsible for all activity under your account, unless you promptly notify us of unauthorized use
Some features of the App (such as AI generation and subscription checks) require an active internet connection. • You are responsible for any data charges or fees imposed by your mobile network or internet provider • We are not liable if the App does not function properly due to lack of connectivity, device incompatibility, outdated software, or issues beyond our reasonable control
The App, including its software, design, graphics, trademarks, logos, and other content (excluding your User Content), is owned by Mert Cagan Yerlikaya or its licensors. • Nothing in these Terms transfers ownership of our intellectual property to you • You may not use our name, logo, or branding in a way that suggests endorsement or ownership without our prior written consent
We may modify, update, or discontinue the App (or any part of it) at any time, with or without notice, including by adding or removing features. We are not liable to you or any third party for any modification, suspension, or discontinuation of the App, except as required by applicable law or App Store policies.
These Terms remain in effect while you use the App. We may suspend or terminate your access to the App, or any part of it, at any time if: • You violate these Terms or our policies • You misuse the App or engage in fraudulent or illegal activity • We are required to do so by law or by a third-party service provider You may stop using the App at any time by uninstalling it. After termination, the license granted to you under these Terms will automatically end.
To the maximum extent permitted by law: • The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied • We do not warrant that the App will be uninterrupted, error-free, secure, or free of harmful components • We disclaim all implied warranties, including fitness for a particular purpose, merchantability, and non-infringement Some jurisdictions may not allow certain disclaimers. In such cases, the disclaimers apply only to the extent permitted by local law.
To the maximum extent permitted by law: • Mert Cagan Yerlikaya will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the App • Our total liability for any claim related to the App will be limited to the amount you paid (if any) for use of the App during the three (3) months before the event giving rise to the claim Some jurisdictions do not allow certain limitations of liability. In those cases, these limits apply only to the extent allowed under local law.
You (or your parent/guardian if you are a minor) agree to indemnify and hold harmless Mert Cagan Yerlikaya from and against any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising out of or related to: • Your use of the App • Your violation of these Terms • Your violation of any rights of another person or entity
These Terms are governed by the laws of Italy, without regard to conflict-of-law principles. For users in the European Union, European Economic Area, and United Kingdom, your statutory consumer rights under applicable local laws remain unaffected by these Terms. Any disputes arising out of or relating to these Terms or your use of the App will be subject to the jurisdiction of the courts located in Italy, unless otherwise required by applicable consumer protection laws in your jurisdiction.
We may update or modify these Terms from time to time. When we do so, we may provide notice inside the App or through other reasonable means. Your continued use of the App after changes to the Terms become effective means that you accept the updated Terms. If you do not agree with the updated Terms, you must stop using the App and uninstall it.
